Ninegrid Terms of Service

About these terms

These terms are an agreement between you and 2CSOLUTION (ABN 59 706 612 171), an Australian business, for your use of the Ninegrid: Sudoku app for Android. By installing or using Ninegrid you agree to them. If you do not agree, do not use the app. You can contact us at info@2csolution.com.au.

Your licence to use Ninegrid

We grant you a personal, non-exclusive, non-transferable licence to install and use Ninegrid on Android devices that you own or control, for your own personal, non-commercial use, under these terms and Google Play's terms. We keep all rights in the app, its name, artwork, puzzles, code and design that we do not expressly grant to you.

The free version and ads

Ninegrid is free to play. The free version shows ads through Google's AdMob. Ads are provided by Google under Google's policies, and we do not control which ads appear. Our Ninegrid Privacy Policy explains what the ad software may collect and how you can control it.

Ninegrid Pro

Ninegrid Pro is a one-time in-app purchase. It gives you no ads, unlimited hints, the option to turn off the 3-mistake limit, and 4 extra board themes (White, Paper, Forest, Midnight). It is not a subscription and there are no recurring charges. In Australia it costs A$4.99; Google Play shows the price in your local currency, and the price may change for future purchases.

Ninegrid Pro is bought through Google Play Billing and is tied to the Google account you used to buy it. You can restore it on another device by signing in to Google Play with the same account and using Restore purchases in the app. Refunds are handled by Google Play under Google Play's refund policies; if you have trouble with a purchase, email us and we will help where we can.

Acceptable use

Please use Ninegrid lawfully and as intended. Do not copy, modify, reverse engineer, distribute, sell or rent the app or any part of it, except where the law allows this. Do not interfere with the app, its ads or Google's services, and do not use the app in a way that is unlawful or harms others.

Changes and availability

We may update, change or discontinue Ninegrid or any feature, including ads and purchases, at any time. We may release updates through Google Play, and some updates may be needed for the app to keep working. Features and availability can change; the Google Play listing shows the current version.

Third-party services

Ninegrid uses Google Play (for distribution and purchases) and Google AdMob (for ads in the free version). Those services have their own terms and privacy policies, which apply to your use of them. We are not responsible for Google's services.

Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law or any other law that cannot be excluded.

Disclaimer and limits of liability

Apart from the guarantees described above, Ninegrid is provided "as is" and we make no other promises about it, including that it will be error-free or always available. To the extent the law allows, we are not liable for any indirect or consequential loss arising from your use of the app, and our total liability to you for any claim relating to the app is limited to the amount you paid for Ninegrid Pro, if anything. Where the law does not allow a limit to be excluded, our liability is limited to re-supplying the app or paying the cost of re-supply, at our choice.

Ending the agreement

You can stop using Ninegrid at any time by uninstalling it. We may end your licence if you breach these terms. Ending the agreement does not affect any rights you have under the Australian Consumer Law or Google Play's refund policies.

Governing law

These terms are governed by the laws of Queensland, Australia, and you agree to the non-exclusive jurisdiction of its courts.

Changes to these terms

We update these terms when they need to change, and the effective date changes with them. Changes apply from their effective date and are not retrospective. Continuing to use the app after a change means you accept the updated terms.
